OVERVIEW

Welcome to Landed! The terms “we,” “us,” and “our” refer to Landed Project LLC, doing business as Landed (“Landed”).

Landed operates this store and website, including all related information, content, features, tools, products, and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Landed is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you have given consent for any minor dependents to use the Services on devices you own, purchase, or manage.

To use the Services, including accessing or browsing our online store or purchasing products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information.

You represent and warrant that the information you provide is correct, current, and complete and that you have all rights necessary to provide this information.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make every reasonable effort to accurately represent our products and services, including colors, materials, features, sizing, and appearance.

However, product colors or appearance may vary depending on your device, display settings, lighting, manufacturing variation, and other factors.

All product descriptions are subject to change without notice. We reserve the right to discontinue products or limit the quantities of products offered to any person, geographic region, or jurisdiction on a case-by-case basis.

Product availability may change without notice, and certain products may be available only in limited quantities.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase.

Landed reserves the right to accept or decline an order at its discretion. Your order is not accepted until Landed confirms acceptance, and payment must be received and processed before an order is accepted.

Please review your order carefully before submitting it.

If you need to change or cancel an order, contact us as quickly as possible. Requests made within 3 hours of purchase will be accommodated when the order status allows it, but changes or cancellations cannot be guaranteed once fulfillment has begun.

If we do not accept, change, or cancel an order, we will attempt to notify you using the contact information provided with the order.

Purchases are subject to our Refund Policy.

Purchases are intended for personal or household use and not for unauthorized commercial resale.

SECTION 4 - PRICES, PROMOTIONS AND BILLING

Prices, discounts, and promotions are subject to change without notice.

The price charged for a product or service will be the price in effect when the order is placed and will be reflected in your order confirmation.

Unless otherwise expressly stated, posted prices do not include applicable taxes, shipping, handling, customs, duties, or import charges.

Prices offered through landedfootwear.com may differ from prices offered by independent retail partners or other third parties.

Promotions may be governed by separate terms and conditions. If specific promotional terms conflict with these Terms, the promotional terms will govern that promotion.

A sale, promotion, or price change occurring after an order is placed does not automatically entitle a previous purchase to a refund of the price difference.

You agree to provide current, complete, and accurate purchase, payment, and account information.

By providing payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your purchase.

SECTION 5 - SHIPPING AND DELIVERY

Shipping and delivery times are estimates and are not guaranteed. Delays may occasionally occur due to shipping carriers, customs processing, weather, or other events outside our control.

Free standard shipping is currently available on qualifying U.S. orders of $99 or more.

Standard orders typically ship within 1–3 business days. Expedited orders placed by 1 PM ET typically ship the same business day.

Shipping rates for orders that do not qualify for free shipping are calculated at checkout based on the items ordered, shipping destination, and order value.

International shipping availability, rates, duties, taxes, customs charges, and service fees may vary by destination and will be displayed or calculated as part of the international checkout process where applicable.

Once your order ships, tracking information will be provided when available.

If your shipment appears lost, significantly delayed, delivered but not received, or otherwise abnormal, contact support@landedfootwear.com and we’ll help review the situation.

SECTION 6 - RETURNS AND EXCHANGES

Eligible products purchased directly from landedfootwear.com may be returned or exchanged within 60 days of delivery.

For a standard return or exchange, products must be new, unused, and returned with their original packaging and tags intact.

Customers who purchased eligible RE:DO return and exchange protection at checkout may receive a covered return shipping label according to their RE:DO coverage. Customers without applicable RE:DO protection are responsible for the return shipping label fee.

International exchanges are not currently available. Eligible international products may be returned within 60 days of delivery, with the customer responsible for applicable return shipping costs.

Products purchased from an independent retail partner are generally subject to that retailer’s return and exchange process.

SECTION 7 - 1-YEAR LANDED GUARANTEE

Landed products purchased from us are covered for one year from the original purchase date against manufacturing defects in materials or workmanship.

If a product fails because of a manufacturing defect during that period, we’ll work to make it right. Depending on the circumstances and product availability, the appropriate resolution may include a replacement, repair, store credit, refund, or another reasonable solution.

The Landed Guarantee does not cover normal wear and tear, activity-related abrasion, improper care, accidental damage, product abuse, or modification.

Heavy use by itself does not mean a product is defective. At the same time, an issue will not automatically be considered normal wear simply because a product has been used.

SECTION 8 - INTELLECTUAL PROPERTY

Our Services, including trademarks, brands, text, displays, images, graphics, video, audio, website design, and other original content, are owned by Landed, our licensors, or other applicable rights holders and are protected by applicable intellectual-property laws.

These Terms permit you to use the Services for personal, non-commercial purposes only.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, sell, or commercially exploit Landed content without prior permission except where permitted by law.

Landed’s names, logos, product and service names, designs, and slogans may be trademarks of Landed Project LLC or its licensors and may not be used without permission.

All rights not expressly granted herein are reserved.

SECTION 9 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services.

We may not monitor or control these third-party tools. Access to such tools may be provided “as is” and “as available.”

Your use of third-party tools may also be governed by the applicable provider’s terms and policies.

We may offer new features, tools, or resources through the Services in the future. Such features will also be considered part of the Services and subject to these Terms.

SECTION 10 - THIRD-PARTY LINKS

The Services may contain links, materials, or functionality provided or operated by third parties.

We are not responsible for examining or evaluating the content or accuracy of third-party websites or services you choose to access.

If you leave our Services to access third-party websites or services, you do so subject to the terms and policies of those third parties.

SECTION 11 - RELATIONSHIP WITH SHOPIFY

Landed is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Landed.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Landed, including any injury, damage, or loss resulting from purchased products and services.

You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Landed.

SECTION 12 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy.

Certain personal information may also be subject to Shopify’s Privacy Policy.

Because the Services are hosted by Shopify, Shopify collects and processes certain personal information relating to access to and use of the Services in order to provide and improve the Services.

Information submitted through the Services may be transmitted to Shopify and other service providers, including providers that may operate in countries other than where you reside, as necessary to provide the Services.

Please review our Privacy Policy for more information about how Landed and our service providers collect, use, and share personal information.

SECTION 13 - FEEDBACK AND CUSTOMER CONTENT

If you submit ideas, suggestions, feedback, product reviews, proposals, or other feedback intended for Landed’s consideration or publication (“Feedback”), you grant Landed a worldwide, royalty-free license to use, reproduce, modify, publish, distribute, and display that Feedback for purposes related to operating, improving, and promoting Landed and our Services.

You represent that you own or have the necessary rights to submit your Feedback and that your Feedback does not violate another person’s intellectual-property, privacy, or other rights.

Photographs, videos, stories, or other creative content submitted through a specific Landed customer or community program, including Proof of Rad, may be subject to separate permissions presented when that content is submitted. Participation in such a program does not automatically grant Landed unlimited promotional rights beyond the permissions provided by the customer.

We may monitor, edit, or remove content that we reasonably determine violates these Terms or applicable law.

SECTION 14 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally, information available through the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability.

We reserve the right to correct errors, inaccuracies, or omissions and to update information or cancel affected orders when reasonably necessary.

If Landed cancels an order after payment has been collected, the appropriate refund will be issued.

SECTION 15 - PROHIBITED USES

You may access and use the Services only for lawful purposes.

You may not use the Services to:

• Violate applicable laws or regulations.
• Infringe Landed’s intellectual-property rights or the rights of others.
• Harass, abuse, threaten, defame, or unlawfully harm another person.
• Transmit false, fraudulent, or misleading information.
• Transmit viruses, malware, or other harmful code.
• Send unauthorized spam, phishing attempts, or similar solicitations.
• Impersonate another person or entity.
• Collect or misuse personal information without authorization.
• Attempt to gain unauthorized access to the Services, customer accounts, or related systems.
• Interfere with or circumvent security or authorization features.
• Scrape, extract, reproduce, sell, or exploit portions of the Services without authorization.

We reserve the right to suspend, restrict, or terminate access if we reasonably determine that these Terms have been violated.

SECTION 16 - AGENTS

This section applies if you use, enable, or deploy autonomous or semi-autonomous software or services (“Agents”) to access, use, or interact with the Services.

Agents must accurately identify themselves as automated systems and may not conceal or misrepresent their automated nature.

Agents may not circumvent CAPTCHAs, access controls, security measures, robot exclusions, or other measures intended to restrict or control automated access.

We may limit or prohibit Agent access to the Services, including through technical measures.

SECTION 17 - TERMINATION

We may terminate or restrict access to the Services, or any portion thereof, when reasonably necessary, including in response to violations of these Terms.

You remain responsible for amounts properly due prior to termination.

Sections that by their nature should survive termination—including Intellectual Property, Feedback and Customer Content, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Governing Law, and Privacy—will continue to apply.

SECTION 18 - DISCLAIMER OF WARRANTIES

Information presented through the Services is provided for general informational purposes. While we make reasonable efforts to provide accurate information, we do not guarantee that all information will always be complete, current, or error-free.

Except for express warranties or promises made by Landed, including the 1-Year Landed Guarantee, and except where prohibited by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that access to the Services will always be uninterrupted, timely, secure, or error-free.

Nothing in these Terms is intended to limit rights or warranties that cannot lawfully be excluded.

SECTION 19 - LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Landed Project LLC and its owners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the Services.

Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.

SECTION 20 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Landed Project LLC, Shopify, and our respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, damages, liabilities, and reasonable costs arising from:

1. Your breach of these Terms;
2. Your violation of applicable law or the rights of another person; or
3. Your unlawful or unauthorized use of the Services.

We will provide reasonable notice of an indemnifiable claim and may participate in or control its defense as permitted by applicable law.

SECTION 21 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted by applicable law or severed to the extent necessary.

The remaining provisions will continue in full force and effect.

SECTION 22 - WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

These Terms, together with the policies and operating rules referenced herein, constitute the agreement between you and Landed regarding your use of the Services and supersede prior versions relating to the same subject matter.

SECTION 23 - ASSIGNMENT

You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent.

We may transfer or assign these Terms and our rights and obligations in connection with a merger, acquisition, restructuring, sale of assets, or other lawful transfer of our business.

SECTION 24 - GOVERNING LAW

These Terms of Service and any separate agreements through which we provide the Services are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

To the extent permitted by applicable law, legal proceedings relating to these Terms or the Services will be brought in the appropriate state or federal courts located in Utah.

The headings used in these Terms are included for convenience only and will not limit or otherwise affect their interpretation.

SECTION 26 - CHANGES TO TERMS OF SERVICE

You may review the current version of these Terms of Service at any time on this page.

We reserve the right to update, change, or replace portions of these Terms by posting an updated version to our website.

When required by applicable law, we will provide appropriate notice of material changes.

Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
